Q&A: Is carrying a real closed sword illegal? Is carrying a toy wooden sword illegal?

Question by Ninja: Is carrying a real closed sword illegal? Is carrying a toy wooden sword illegal? I was organizing my costume for Halloween, and I'm deciding if I could carry a genuine sword on my back, and of course.. it really is in the sheath. It really is about 4 feet total, the blade is around three feet. Also I'm asking yourself the very same issue about a wooden toy sword, but it's not a lot of a sword to the point where you could hurt somebody, just looks like it, without a sheath too. as far as i no most of the laws regarding blades are about knifes, i have in no way seen a law about carrying a sword. that becoming mentioned the only way i would think of u getting in difficulty would be if u had been "concealing" it but on your back is pretty out in the open. to be on the secure side i would not take it out a lot. In the strictest sense, no it is NOT illegal. However. . . prior to you start off carrying a sword, here are some laws you might want to contemplate: Penal Code section 12020 covers harmful and illegal weapons. One particular of the listed weapons that are prohibited are what is recognized as "dirks" and "daggers". These are any weapon, with or with out a hand guard that is capable for instant use as a stabbing weapon. Those are illegal if carried concealed. So - despite the fact that it may well be technically legal to carry a sword in plain view, do you want to be held at gunpoint by an officer for your subsequent traffic infraction while the two of you debate the fine points of California law?
